I took a loan on XX/XX/year> using Uplift to pay XXXX XXXX. In the amount of {$2200.00} I have payments with no problem until XX/XX/year>. My regular payments are {$160.00} using my bank account. I also noticed that they charge ridiculously amount of interest if you use their option to delay payment. I also noticed the terms and condition along with their operations maybe in violation of the law.
My issue for filing this complaint today XX/XX/year> is a payment issue. A double payment was made on XX/XX/year>, Friday for {$160.00}. I called my bank and Uplift/ XXXX XXXX. I was informed by a Uplift agent that is was there app error that has been down for a few months or glitch. They noted this in their system and told me I would be refunded. I kept calling and emailing them. I called last week several times and they told me they had to wait until the payment posted or cleared the bank first to refund. A week later the payment was cleared but no refund for the double payment. I filed a dispute with my XXXX XXXXXXXX. I received a text message alert on XX/XX/year> Saturday saying payment failure and when i logged into my account on the browser website I noticed the double charge or {$160.00} was gone, likely due to my bank dispute. I called this morning / today on XX/XX/year> and spoke to an agent about the refund for the double charge. Instead of complying with my request the lady agent refunded my current payment for the amount which is {$160.00}. I told her this was incorrect and almost immediately my account turned red saying past due {$160.00}. The agent wasn't well trained and made several mistakes. The phone called disconnected. I called back and male agent answer my call. He saw what happened and was noted in the system. He told me he couldn't stop the actions of the last agent and couldn't get the refund for my regular payment to stop but TOLD ME SINCE MY ACCOUNT IS NOW PAST DUE YOU CAN MAKE ANOTHER PAYMENT! Seems illegal. I would like billing issues fixed and refund. I can't even use my current bank account to make any payments on their website being blocked.

Per the FCRA, I XXXX XXXX as a federally protected consumer, I am now opting out of any and all authorization I the consumer may have given you written, unwritten, verbal and nonverbal per 15 USC 6802 to report my information to a third party, effective immediately and indefinitely. Please update account to PAID AS AGREED. I understand that the debt has been charged off/certificate of indebtedness and can not be reported to my credit report. I am requesting compensation {$1000.00}, for every violation.
According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states ( Permissible purposes of consumer reports, you can not report transaction history ).
" There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX and XXXX etc., are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states, " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of that customer nonpublic personal information. '' Also 12 CFR 1016.7 states that A consumer may exercise the right to opt out at any time. '' I am opting out of the reporting services listed above as well as your company.
Privacy Act of 1974 the Privacy Act of 1974, a law that protects the privacy of individuals by regulating the collection, maintenance, use, and disclosure of their records by Federal agencies.
15 U.S. Code 1681n - Civil liability for willful noncompliance for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater.
313.1 Purpose and scope.
( a ) Purpose. This part governs the treatment of nonpublic personal information about consumers by the financial institutions listed in paragraph ( b ) of this section. I don't have access to internet all the time so I can not receive online bills all the time. I need them to send me paper bills " Each month '' so as to be able to set up payment source to send them payment each month. They refuse to do so and it is " MY RIGHT '' as an " XXXX XXXX '' to receive paper bills. I ask the Upgrade Representative to send me email to confirm ( They won't send paper bills ), she refused and said ; quote '' We don't send emails ''. NO where in the " TIL document '' or the " Loan Agreement Document '' does it say I can't receive paper bills each month. I need them in order to send them payment every month in a check. An account has been open using my personal information with a loan company called Upgrade, also with a XXXX XXXX XXXXXXXX XXXX XXXX. I have recently been made aware that a loan has been authorized without my knowledge until I received a welcome packet from XXXX which led me to look into this identity theft issue. I have spoke with Upgrade via email & phone numerous times & they are not very helpful & are even requesting more personal info. or they would not proceed with the fraud investigation. I have been informed per XXXX that the loan amt on my credit report is showing {$8500.00} on XXXX. I am claiming this is not my account and I did not approve to receive this amt. We have found that there was an amount of {$1600.00} that was deposited into my personal bank acct as they also had my routing and banking number for this acct. I am not aware of where exactly the additional amount has been applied too as no info is being provided to me from Upgrade. This {$1600.00} was deposited in my personal acct. in error and is in the process of being returned. The confusion was that the IRS was set to deposit a tax refund in that exact amt which made me believe that was where that money came from. I have made Upgrade aware of this as well as my bank.

When I applied for and was approved for the UpGrade XXXX XXXX XXXX XXXX I was promised a {$200.00} cash bonus after making 3 ontime payments. I opened the account in XX/XX/XXXX. All monthy payments have been made on time. I have made several calls regarding this and each time I was told that the matter would be escalated. I was told that I was due the {$200.00} bonus. On the call that I made on Wednesday, XXXX XXXX, XXXX I was told that the matter was being corrected and {$200.00} would be deducted from my total balance due within 5-7 business days. Today is the 8th business day. I called again. On this call I was told that I did not qualify for the {$200.00} bonus because I have 2 different cards with them. This was the 1st time I was told this. I began calling UpGrade about this in XXXX. I made several calls since then. On each and every call I was told that I was qualified and should receive the bonus. This has been a very stressful and time consuming matter.

The company is Upgrade and they made a hard inquiry on my credit report and I was alerted that it was made. This was not authorized and I did not apply. I tried calling this Upgrade company only to be put on hold for 62 minutes with a recording being played constantly saying someone would be with me shortly. I have frozen all three creditors ( XXXX, XXXX, and XXXX ).
The email I received was sent at XXXX XXXX CST and it was for a Personal Credit Line. It was supposedly issued be XXXX XXXX XXXX, a New Jersey State Chartered Commercial Bank, Member FDIC, Equal Housing Lender. The Upgrade Card was issued by XXXX XXXX, Member FDIC, pursuant to a license from Visa U.S.A. Inc.
I also file a complaint with the Internet Crime Complaint Center but I want whoever is doing this stopped and this inquiry removed from my report. I don't want this to happen to anyone else. I have worked hard to increase my credit score and this has thrown me for a loop.
