Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to the hazard of cranes being overloaded, and/or loads being dropped, due to the absence of rated loads for Below-the-Hook Lifting Devices being conspicuously displayed on the device(s). (a) Crane Bay, Location C-B - On or about June 18, 2014, employees using the DeShazo 2 ton top running bridge crane with under-hung trolley, and using the unidentified 85 1/2 inch long, yellow, reinforced I-beam below-the-hook lifting device to unload copper and PEX piping, were exposed to injury due to the absence of rated load marking(s), nor any identification plates which listed the following information on the lifting device: (a) the manufacturer's name and address; (b) the serial number of the device; (c) the lifter device's weight (if over 100 lbs.); (d) its rated load capacity. 29 CFR 1910.304(g)(6)(vi): Exposed noncurrent-carrying metal parts of cord- and plug-connected equipment that could have become energized were not grounded: (a) CDC, UPS Station - On or about June 18, 2014 employees using the 25 inch diameter Utilitech box fan were exposed to electric shock due to the absence of the equipment grounding prong on end of the fan's 3-wire cord/plug. (b) Gray Bin Area, Center Aisle Zone at GB-09-013-03A - On or about June 18, 2014 employees using the 22 inch diameter Utilitech black pedestal fan were exposed to electric shock due to the absence of a continuous grounding path. (c) CDC Shipping Area, near Aisle #1 - On or about June 18, 2014 employees working in and around the 18 foot tall metal storage racks were exposed to electric shock due to the absence of an equipment grounding prong on the plug of a US Wire & Cable Corp. 100 foot, round, yellow, AWG 12/3 extension cord which was supplying current to an elevated round gray box fan mounted to end of the rack about 15 feet above the floor. (d) HVAC Building - On or about June 19, 2014, employees using the Lantech Shrink-Wrap Machine were exposed to electric shock due to the absence of a grounding prong on the machine's 3 wire cord/plug. (e) North Center of HVAC Building at Roll-up Door - On or about June 19, 2014, employees working around the 30 inch diameter Comfort Zone Pedestal Fan were exposed to electric shock due to the absence of the grounding prong on the fan's 3 wire cord/plug. (f) HVAC Building's West Roll-up Door - On or about June 19, 2014, employees working around the 36 inch diameter portable Maxx Air Fan on wheels were exposed to electric shock due to the absence of the grounding prong on the fan's 3 wire cord/plug. |
