Complaint What Happened This CFPB complaint has been filed to request pursuant to FCRA 605B ( 15 U.S.C. 1681c-2 ) that you, the XXXX credit reporting agency , block information appearing on my consumer credit report that is the result of identity theft and fraud within 4 business days of your receiving this complaint. The fraudulent, inaccurate, and false information consists of a personal car loan account opened at XXXX/MAZDA FIN SV on XX/XX/2020 under the account number ( private ), and a personal car loan account opened at MAZDA FINANCIAL SERV and MAZDA FIN SV on the same date under the accounts numbers ( private ). These accounts have led to several fraudulent hard inquiries and unauthorized collections appearing on my consumer XXXX credit report. I have attached a list of the hard inquiries in question as well as a copy of the consumer XXXX credit report maintained by you, which shows the aforementioned fraudulent items. I do not recognize the mentioned accounts, collections, or hard inquiries as reported. They were not opened, made, or initiated by me. All of the mentioned accounts, collections, and hard inquiries are a result of identity theft and fraud. As proof, I have attached a copy of FTC Identity Theft Criminal Complaint # ( XXXX ) from the US Federal Trade Commission, indicating that all these consumer credit accounts, collections, and hard inquiries are linked to identity theft and fraud.

Complaint What Happened Is in violation of Holder in due course rule. They ate holding my contract without reserving the rule of the holder in due course rule. Toyota received my contract and didnt credit me for the contract is in violation because according to the rule it preserve my defenses and my claims to proceed of the note that was issue to the seller which is the dealership before it was issue to the creditor which would be the bank or anybody that ended up being the holder of the note. The vehicle is for my person use they have no right to charge me for the note. The note was the payment that they received and proceeds from the note was what I was entitled to credit for. They cant make me pay without them paying me.

Complaint What Happened I was told by the dealership that I had to put a down payment of {$10000.00} in order for the bank to fiance the XXXX. I call the people who fiance the contract and I was told by them that they dont require a down payment and that was the dealership doing. I was explaining to them the violation of TILA. 15 usc 1605 ( c ). I had to pay for insurance before I could get the vehicle. 15 U.S. Code 1635 - Right of rescission as to certain transactions.

Complaint What Happened XXXX XXXX XXXX in XXXX, XXXX adding on a XXXX Commercial GAP insurance for {$850.00} and XXXX Vehicle Service Contract for {$3300.00} to customers invoices without asking if they would like to purchase these services or state that they are optional. They commingle the paperwork for these optional services with required paperwork for the vehicle purchase. There position is that they have all of the paperwork signed to support the services sold. I explained to them that if the obtained these signatures in an improper manner by not asking a customer if they would liked to purchase optional services, this is fraud. Additionally, the GAP waiver is a sham product that flew people would purchase if specifically asked. If in spirt, it was not presented as optional its cost needs to be disclosed in the APR of the federal truth in lending statement.

Complaint What Happened I leased a brand new vehicle and in XXXX 2016, the vehicle was in a collision deemed a total loss by an adjustor - other party at fault. The at fault party 's Insurance company XXXX XXXX XXXX XXXX indicated they would pay balance in full and complete settlement with Toyota Financial Services. Federated Insurance company paid balance except for {$660.00}. Toyota Financial Services indicated that they were working the settlement out with the insurance company. I never heard back from Toyota regarding the issue and when I called Toyota Financial Services customer service line and input my account information, the prompt indicated " This account is closed '' and that there was no balance. Toyota Financial Services called me on Thursday, XXXX XXXX, 2016 ( 3 months after my last contact with them ) at XXXX XXXX and left a voicemail asking me to return their call and that it was urgent. I called back on XXXX XXXX, 2016 at XXXX XXXX and spoke to a customer service representative who said : " I do n't know why that person called, your account is closed and you do n't owe anything so you can disregard that voicemail. '' I then received a letter stating that I owed the remaining balance on the vehicle. Before receiving this letter, I was never notified that there was an outstanding balance nor was I notified that I had to provide any additional information to Toyota Financial. I called Toyota Financial Services on XXXX/XXXX/2016 at XXXX XXXX and talked to a Total Loss Representative who told me that if I could not provide a copy of an " Evaluation Settlement Breakdown '' and Police Report to Toyota Financial Services by XXXX XXXX, 2016, my account would be charged off to collections. This was the FIRST notification I received from Toyota Financial Services from XXXX to XXXX, and the first notification ever that I needed to provide additional information to Toyota Financial Services, on top of the fact that XXXX of their customer service representatives told me " your account is closed and you do n't owe anything. '' Furthermore, the insurance company representative XXXX XXXX indicated that she told Toyota Financial Services during the settlement that they do not give out copies of Evaluation Settlement Breakdowns, but I was never notified by Toyota Financial Services that there was additional information I needed to provide to them. I feel the treatment from Toyota Financial Services is very unfair, especially the fact that they waited until XXXX XXXX and one week before the charge was passed to collections XXXX to notify me that if I did not provide information that the insurance company was supposed to provide. I also feel deceived because a customer service representative who works with Toyota Financial XXXX 's customer support XXXX earlier indicated that my account was closed and that I did not owe anything, only then to have Toyota Financial Services come back and say I owe {$660.00}.
