Infiniti financial reported me 30 days late in XXXX/XXXX 2020. I contacted the company about the credit reporting of 30 days late. They informed me that they never reported me 30 days late. Despite them denying the fact that they reported me 30 days late in XXXX /XX/XX/2020, my credit report still reflects 30 days late in XXXX/ XX/XX/2020. Also, I filled out a credit dispute on the 30 days late with XXXX, XXXX, and XXXX. My credit reports reflect that dispute was resolved, yet I still have 30 days past due showing on my credit report for XXXX/XX/XX/2020. This issue never was resolved.
My credit score dropped over 60 points from this misreporting/ error on my credit report. I'm suffering greatly from this misreporting and have been denied for car refinance loan and debt consolidation loan due because the 30 days past due and my credit score dropping over 60 points. Lastly, I contacted Infiniti in XXXX and XX/XX/2020 via phone and letter. I never received any correspondence from the letter to Infiniti at all.

In XXXX XXXX, my XXXX XXXX XXXX was totaled and deemed a total loss due to electrical problems. When financing, I purchased GAP insurance and an extended warranty. The GAP insurance was through a company named XXXX. It took me awhile to collect all of the documents but it was filed within the 90 days and the claim was processed. The next step was to file a cancellation on the extended warranty and that was handled by a company named XXXX. As soon as I received notice that my GAP claim had been processed, I filed a notice of cancellation that would cover the remaining balance, which was {$690.00}. I knew I needed to handle the payoff but at the end of XXXX, I placed a call to XXXX, which is on their record inquiring whether or not I needed to cover the remaining balance or wait until they received the warranty cancellation refund. I was instructed to not worry about the balance, that it would take longer for them to issue the refund check if I went ahead and paid it off. Three days later, they charged off my account causing my credit score to plummet. I immediately called back and spoke to another representative who told me that they would reverse the charge off once they received the refund check, as well as apologizing that I was n't notified of the charge off during my previous conversation. A week later, I still had not received notice of the refund check and called XXXX, the cancellation company. I spoke with a manager and she apologized for the delay and she would overnight the check, this was XXXX/XXXX/XXXX. I received the overnight notice XXXX/XXXX/XXXX. I called XXXX again to make sure the refund was received and it had been posted XXXX/XXXX/XXXX. I was instructed that the charge off would be deleted and I would be receiving a refund of {$670.00}, twenty one days after the check posted. That would have been XXXX/XXXX/XXXX. It is now XXXX/XXXX/XXXX and my account has n't been adjusted nor have I received my refund check. I understand that it takes time to issue checks but the fact that my credit has not been adjusted is unacceptable. Before my car was totaled, I always paid on time and remained in good standing with the company. The lack of information and misguidance on the part of their representatives is disappointing.

The company is XXXX XXXX of XXXX, MS . When I explained that the car was one price on the internet, they explained that this tactic was to lure people into their business. They don't honor the internet price, so I decided to change vehicles. The second one I chose, there were credits that were part of the deal of the loan : {$1200.00} Rebate & {$2500.00} New customer cash. I saw these on the internet and also confirmed them with the office when I talked about financing. I only received one credit of {$1200.00} ( Rebate ) but then it was charged back to me in the transaction. I never received the {$2500.00}. The special ends on XX/XX/18, but I completed my transaction XX/XX/18. I tried to call today XX/XX/18 with no response from the office. I am driving over today as well. Whether I receive the second credit or not, this needs to be known. I have a feeling that my payment was increased because of these missing credits. The paperwork started my payment at XXXX down and 72 months at {$460.00}, but after adding the service plan, my payment increased to {$540.00}. After expressing I didn't want the payment to increase, the salesman explained that I would lose my credits, and my rate would change from 1.9 %, but I wasn't given the bulk of it.

I called XXXX on or around the time I contracted XXXX XXXX and my job was affected. In XX/XX/XXXX I spoke with 2 different supervisors on a recorded line about the billing error and was told that if I made consistent on time payments for 6 months, they would remove my late payments. My credit report has been adversely affected by my lost of employment due to the worldwide Covid pandemic. After being assured by the management at XXXX that the erroneous late payments would be removed, I've been caught up and consistent an entire year since finding stable employment. I called XXXX today XX/XX/XXXX and The representative refused to submit my dispute for the erroneous late payments and refused to transfer me to a supervisor. ThIs information on my credit report is preventing me from purchasing a home. I would have never been in this position if i wasnt assured that the late payments would not affect me after keeping consistent payments. I feel like this is some form of extortion. If i would have known that XXXX would be this shady, i would have went to another finance company.

Date : XX/XX/18 Amounts : Old Vehicle - {$46000.00} Actions by me : Requesting pay-off with management at location due to the sales tactics that were used.
Events : I went to XXXX XXXX XXXX looking to trade in my XXXX XXXX to go with something a little more economical. I was informed that there was no option to trade due to balance on truck, ( this was after they took my keys and processed an appraisal. ) I told them no problem and that I would want to keep my truck and continue to pay for it. However, I had test drove a vehicle and they started processing numbers and told me to wait and that I needed to voluntarily surrender my truck to the bank I originally got the loan from, in this situation I asked for my keys and they were not given to me. They had the sales representative follow me to the bank down the road to ensure I gave the truck to them, then had me go back to the dealership and sign for paperwork on the vehicle I test drove. Now I have to suffer on my credit for a vehicle that is not delinquent, due to their XXXX sales tactics. I was intimidated and was forced to do this. I was informed by both the salesman and the Finance Manager that I had no other option and that I was lucky they were looking out for me. This is not the case.

You are subject to criminally liability for violating 15 U.S.C. 1961 as I have proof that I was discriminated against by NISSAN MOTOR ACCEPTANCE CORPORATION due to the response that I received.
NISSAN MOTOR ACCEPTANCE CORPORATION is in violation of 15 U.S.C. 1681m and 12 C.F.R. 1002 because I, the consumer made an application in good faith, but credit was not issued.
Furthermore, because my social security number ( credit card ) was used, and I received no benefit. This is proof of fraudulent activity ( unauthorized use of credit card ) on behalf of NISSAN MOTOR ACCEPTANCE CORPORATION.
If NISSAN MOTOR ACCEPTANCE CORPORATION fails to make any reasonable procedures to resolve this matter and compensate me for the use of my credit card, I will indeed make NISSAN MOTOR ACCEPTANCE CORPORATION criminally and civilly liable for all actual damages pursuant to 15 U.S.C. 1681n and 15 U.S.C. 1681o.

I called XXXX on or around the time I contracted XXXX XXXX and my job was affected. In XX/XX/XXXX I spoke with XXXX different supervisors on a recorded line about the billing error and was told that if I made consistent on time payments for 6 months, they would remove my late payments. My credit report has been adversely affected by my lost of employment due to the worldwide XXXX pandemic. After being assured by the management at XXXX that the erroneous late payments would be removed, I've been caught up and consistent an entire year since finding stable employment. I called XXXX today XX/XX/XXXX and The representative refused to submit my dispute for the erroneous late payments and refused to transfer me to a supervisor. ThIs information on my credit report is preventing me from purchasing a home. I would have never been in this position if i wasnt assured that the late payments would not affect me after keeping consistent payments. I feel like this is some form of extortion. If i would have known that XXXX would be this shady, i would have went to another finance company.

On XX/XX/XXXX, Nissan Motor Acceptance Corporation ( NMAC ) received a check from XXXX for funds totaling {$16000.00} to pay off my truck lease. I financed the purchase of the truck through XXXX. On XX/XX/XXXX, NMAC sent a letter to XXXX requesting a completed and signed odometer statement. Apparently the completed and signed odometer statement XXXX sent with the payoff check to NMAC was misplaced in processing. I was sent a copy of the letter " for information only. '' After speaking with NMAC multiple times in XX/XX/XXXX to resolve this issue, it was determined by NMAC that a new completed and signed odometer statement was all that would be needed to close the lease account. On XX/XX/XXXX, a new completed and signed odometer statement was faxed to NMAC, along with a copy of the XX/XX/XXXX letter from NMAC that stated in writing the payoff funds had been received. On XX/XX/XXXX, I obtained a payoff letter from the NMAC payment website, confirming a payoff due of {$0.00}. Apparently the payoff information was not provided to the NMAC leasing division. As a result, the account has been reported to all three CRAs as 30 days late. I filed disputes with all three CRAs, and they are reporting that NMAC verified 30 days late as accurate. This lease account was paid on time with no missed payments, and the payoff amount that XXXX sent was quoted by NMAC.

I had gotten a XXXX Nissan Altima Coupe for my daughter and on or around XXXX XXXX, XXXX I got a flyer in the mail from Nissan for an option to trade in my lease for another lease without penalty or any money owed. I called Nissan Motor Corp. and was informed that it was indeed correct as long as my account was up to date. I had not even considered another lease until this time as nothing was wrong with the car. I then called XXXX XXXX Nissan in XXXX, MS., because they are the dealership I used to buy and lease my Nissans. They said that I could get another lease and they instantly started trying to locate the vehicle my daughter wanted, another XXXX XXXX, simply a different color.
On XXXX XXXX, XXXX I went to XXXX XXXX Nissan to turn in the XXXX Altima Coupe for the XXXX Altima Coupe and was told that I owed absolutely nothing by the Finance/Sales Manager XXXX. Also, the salesperson, XXXX XXXX, assured me twice that I owed nothing. I left with the brand NEW lease car and they kept the XXXX. I started receiving phone calls from XXXX XXXX XXXX about a month later stating that I was behind on the XXXX lease payments. I told them that car had been turned in and I had a new lease. They then informed me that the XXXX had not been paid off by the XXXX XXXX Nissan dealership and that I was still responsible for it too.
I called the XXXX XXXX dealership and was told that there had been some confusion between them and Nissan Motor Corp., because they had paid the car off. I continued to get calls from Nissan Motor Corp. and bills in the mail. I kept calling XXXX XXXX Nissan and was told it had been paid off.
In XXXX I received a call from a collector named XXXX, at Nissan Motor. I told her what had happened so she said she would call XXXX XXXX XXXX and speak to the Finance/Sales Manager, XXXX. Approximately 10 minutes later she called me back to say that XXXX had just then paid the car off.
After thinking this was the end of this confusion, I called the owner of XXXX XXXX Nissan, XXXX XXXX himself, and explained to him what had happened. I also told him that his loan officer had run my credit through XXXX banks when he was n't supposed to even be running it. The lease was only going to be with Nissan/XXXX XXXX so there was no need to run my credit through any banks. He never asked my permission for that. XXXX, apologized and said he would find out what had happened.
In XXXX, I received another bill from Nissan Motor Corp., saying that I owed {$9300.00} for the XXXX that they kept. I called Nissan again and was told that this car was never paid off by XXXX XXXX Nissan and I was still responsible for the bill.
I called XXXX XXXX and he said that he knew I did n't owe any money but he could n't help me or he might lose his job. I called XXXX XXXX, the owner, numerous times but he would not speak to me. Finally I reached him and he said he was sorry but it was not his responsibility to take care of this. XXXX the Finance/Sales Manager was no longer employed there so I could n't talk to him.
I did not under any circumstances have to turn that car back in and if they had not sent the flyer ( which also came up missing from XXXX XXXX Nissan ) I would never have even considered another lease. Who lets you take a brand new lease car home if you owe them {$9300.00}?? No car dealership that I have ever heard of would let you leave with another car if you owed them anything.
I am trying to refinance my house and Nissan has this on my credit report still saying that it was a " Write Off '', when in fact it was their mistake. I have it " in Dispute '' on my credit record but I need it removed in order to get my credit back. They have almost destroyed my credit and I had worked very hard to get my scores up.
