Lease buyout completed XX/XX/XXXX, no title as of XX/XX/XXXX. Numerous calls to Hyundai finance with escalations and emails to title dept. Hyundai finance states they are waiting on dmv. I called dmv and they said they have received no request for anything since the vehicle was paid off. Dmv states last request was in XXXX. Hyundai states last request was in XX/XX/XXXX to correct some discrepancy from when i moved to different state. So the numerous calls i made since buying out car about the title was info from XXXX with no new inquiries to the dmv from XXXX. XXXX says they are waiting from XX/XX/XXXX for the dmv to tell them what they need to correct title. I got through to dmv today...

The vehicle that was sold to me new back in XXXX XXXX XXXX was a XXXX XXXX and I was over priced for the vehicle. I think I was over charged for the vehicle at {$28000.00} or maybe more. I dont understand how or what the salesperson did to give me car and the salesperson was fired shortly there after the sale. When I owned the vehicle I was promised full bumper to bumper warranty and shortly there after the car needed repairs thats when I found out that they didnt include the warranty in my deal that we had discussed and I signed off on it not knowing. About XXXX I looked further into the situation and got nowhere. The car took a turn for the worst and wasnt covered by the warranty that I signed up for so I fell behind on payments because of the faulty vehicle. During that time period I also had a few recalls on the vehicle. Since XXXX the vehicle has been in Repo and the vehicle was finally picked up in XXXX. Also before that they were already reporting negatively on my credit and because of that I cant ever get another vehicle. I asked the dealership to resolve the issue and why was the deal changed without my consent I was told it was too late and that they cant do anything about it. Is this a lost cause for me and my situation???? My credit is forever tarnished. I would tell other consumers to stay away from Kia And Hyundai XXXX institutions.

I applied for a loan with XXXX XXXX and had purchased XXXX vehicle during the month of XXXX 2014. I was told that I would be getting a good deal on the vehicles in which i purchased. I later found out that the interest rate charged for the loans at the time was almost XXXX times that of the average consumer for the credit score that I had and when I came back to speak to the finance manager. The dealership had let her go for fudging many of the loans and jacking up many customers interest in order to make a higher commission and she was no longer employed with the company due to her increasing many loans on the interest that some of their consumers were paying. The dealership as of today 's date has never contacted me and had i not inquired I would have never known the truth. When I applied my credit score was showing XXXX approximately and thought that I would get the lowest interest rate at the dealership offered but instead I received an interest rate that was nearly XXXX of that of the regular consumer. I am requesting an investigation on the lending of loans and services of this company based on the following Discrimination based on race, and color, gender for I was charged a higher rate than other consumers of a different race, gender or color I request an immediate investigation on the loans that were processed during the time that I applied and it will show this to be a everyday factor practice based on race and to investigate the transactions of this company and how they are advertising a certain price and then selling their vehicles for more than the advertised price. It is like a bait and switch on the consumer. Predatory lending has clearly been an everyday factor in order for the finance department to make a better commissions on the consumer who is not aware of how the process works. I was charged a higher rate for no reason other than greed. Fair and accurate transaction was not taken into account by dealership. Equal credit opportunity act has been was not taken into account. Gramm leach biley act was not taken into account. After purchasing the vehicle I was called back into the office to sign more paperwork again after the vehicle was in my possession for more than a month. I was told that it was necessary in order to get my military discount. I never got the discount on my vehicles and the price of the vehicles was sold for more than they advertised which I later found out from the XXXX ledger. I am still trying to figure out where is the discount and why was I charged a higher interest rate and why did the finance manager deliberately fudge my loan. consumers of a different race who have purchased from this dealership have lower interest rates than mine with lower credit scores than what I had when I purchased my vehicle. As of today 's date their is no discount, higher interest rate, higher price paid for vehicles and the military rate was applied later and went somewhere else for all I know. It is truly a shock to me to see a dealership do this to a consumer.

I made a payment for XX/XX/XXXX on XX/XX/XXXX. It wss 29 days late for {$480.00}. I made the payment on the site. It uses XXXX XXXX to process payments. My account information is usually pre stored.
The month prior I made a payment over the phone with my debit card. I submitted my payment on the 6th like normal. After a few days, I noticed the money was still in my account. I them checked the emailed receipt and noticed that it had the last four digits of my debit card not checking. You can only do check payments on the site.
I call on the XXXX to let them know the error and used my debit card to make XX/XX/XXXX payments becaue I knew it was going to get returned because the last 4 of my checking was wrong.
I expressed to them that I can't afford a 30 day late payment and it was a glitch on there site.
I got mixed responses from customer care as if I would. I just want to make sure I don't since it was an error on their part

Usually when an account is 90 days late it's your car will be considered for repossession.
My account is NOT 90 days late and my BALANCE OWED is less than {$1000.00}.
Hyundai Finance has locked my account so that I will not be able to make any payments and once my account is considered 90 days past due, they can repossess and make more money by charging fees to obtain the vehicle back.

It is a fact, KIA MOTORS FINANCE hereinafter referred to as Kia '' is a debt collector pursuant to 15 U.S. Code 1692a ( 6 ) and violated 15 U.S. Code 1692e ( 11 ) by failing to disclose in their initial written communication with the consumer that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose and this was not disclosed at least 18 times thus far. Kia has violated several sections of the Consumer Credit Protection Act including but not limited to sections of the Truth In Lending Act ( TILA ), Fair Credit Reporting Act ( FCRA ), and the Fair Debt Collection Practices Act ( FDCPA ) which have been summarized in the attached Affidavit of truth and statement of damages. Kia violated TILA Section 125 ( 15 USC 1635 ) as well as title 12 of the Code of Federal Regulations ( CFR ) Section 1026.23 ( Regulation Z ) by failing to disclose the obligor 's right to rescind the credit sale in accordance with the rescission model forms provided in Appendix G and Appendix H of Regulation Z. Pursuant to TILA Section 111 ( c ) also codified as title 15 USC 1610, ( c ) in any action or proceeding in any court involving a consumer credit sale, the disclosure of the annual percentage rate as required under this title in connection with that sale may not be received as evidence that the sale was a loan or any type of transaction other than a credit sale. Because of the fact that Kia failed to disclose the obligor 's right of rescission and the forms to rescind the transaction, Kia violated " 12 CFR 1026.23 ( c ) Delay of creditor 's performance '' which states " unless a consumer waives the right of rescission under paragraph ( e ) of this section, no money shall be disbursed other than in escrow, no services shall be performed and no materials delivered until the rescission period has expired and the creditor is reasonably satisfied that the consumer has not rescinded. I never waived my right to rescind the credit transaction which means that Kia violated this section over twelve ( 12 ) times since the funds were never disbursed into escrow since day one even though the right of rescission was not waived by myself or the co-signer.
Pursuant to FDCPA Section 812 ( a ) which states " it is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating '', Kia sent me several deceptive forms indicating that the credit sale was a loan. On behalf of Kia, XXXX XXXX stole my vehicle on behalf of XXXX XXXX XXXX who is an unauthorized third party debt collector and I did not give prior written consent to have third party communication which is a violation of FDCPA Section 805 ( b ). Kia has violated several of my federally protected consumer rights by violating several sections of the Consumer Credit Protection Act, Truth in Lending Act, Fair Credit Reporting Act, and Fair Debt Collection Practices Act which are detailed in the attached Affidavit of Truth w/statement of damages. In addition to these facts, Kia mailed me a deceptive form ( included with my attachments ) titled " Explanation of calculation of surplus or deficiency '' which they intentionally " blacked out '' /omitted line 4 " expenses '', line 6 " total amounts paid on your behalf to other secured parties '', line 8 " credit/rebate ( as calculated as of the above date ) '', and also intentionally sent me only the first two of 220 pages that should have been included with this deceptive form. Also, it was not fully disclosed to me that the Seller-creditor " XXXX XXXX XXXX '' would be receiving the amount financed as well as the finance charge just because we signed the contract and chose to buy the vehicle on credit. We were under the assumption that the Seller-Creditor " XXXX XXXX XXXX '' would only be receiving the amount financed.
Pursuant to TILA Section 106 also codified as 15 USC 1605, the finance charge is the " sum of all charges '' and we were charged much more than the finance charge.
Kia also attempted to sell the debt to a third party by the name of XXXX XXXX XXXX, who we also attempted to contact and they have also violated our federally protected consumer rights which have been detailed in one of the attachments including but not limited to FDCPA Section 805 ( c ), 807 ( 2 ) ( A ), 807 ( 2 ) ( B ), and others.

I asked them were they steady running my credit they said no but when I looked at my report I have it on there several times. Re-aged information changing and update account to past due account rolling one payment through a total of 18 months. Refusal to provide accuracy of detail to validate debt. Creditor marked account as a repossession when it is current. Recently marked account the account 30days passed due when it is current. Abuse of updating accuracy to credit bureaus. Duplication of fees in the amount of {$300.00}. Recently sent a bill with an extra {$30.00} fee more than what is due on the account.

I had already made a payment arrangement with Hyundai motor finance got a confirmation number and spoke to them repeatedly but they continue to keep calling me when they already know they have a payment in the system in one day I get more than 5 calls from early in the morning to the late hours at night. My car is almost paid off but yet they keep calling me for a payment and they have a confirmation number too. This company has made this car payment harassment and say they will note my account and never do.
