My initial complaint number is XXXX. I wanted to get help with issues related to missing money from my checking account. The bank claimed that the financial tool that I used from their app was only supposed to be used for informational purposes only. However, the same financial tools can be used for helping with budgeting and managing finances. I used the tool for managing my finances for my checking account and discovered that my account was missing money. The tool indicated that there was more income than income for the checking account than spending. The difference as of today according to the financial tool is a bit over XXXX dollars. I have proof of the spending and income according to the financial tool and proof of unknown transactions from the app. The photographs should show enough proof because of the date of the unknown transactions from this morning. The unknown transactions are for amounts of {$22.00} and {$160.00} today XX/XX/2023. The photos should be attached to this message or uploaded with my complaint.

I am writing to formally demand that you immediately cease and desist all unauthorized activity related to my personal and financial information. This letter serves as a formal notice that your actions constitute identity theft, securities fraud, and fraudulent conveyance, and have resulted in the unconstitutional taking of my private property without just compensation.
Account Extinguishment and Restitution I demand the immediate and complete extinguishment of all accounts, both public and private, that have been fraudulently created or accessed using my personal information. All proceeds derived from these accounts must be returned to me, the rightful owner and taxpayer.
Accounting Standards and Legal Violations The fraudulent creation and use of these accounts violate multiple accounting standards, including those outlined by the XXXX XXXX XXXX XXXX ( XXXX ). Specifically, the unauthorized use of my identity to create and access these accounts constitutes identity theft, a federal crime punishable under 18 U.S.C. 1028. Furthermore, the use of these accounts to engage in securities transactions without my consent constitutes securities fraud, which is a violation of federal securities laws.
The fraudulent creation and use of these accounts also constitute a fraudulent conveyance, as they were created to defraud creditors and other parties. This is a violation of state laws governing fraudulent transfers.
Unconstitutional Taking and Involuntary Servitude The unauthorized use of my personal information to create and access these accounts has resulted in the unconstitutional taking of my private property without just compensation. This violates the Fifth Amendment to the United States Constitution. Additionally, the forced labor and financial burdens imposed on me as a result of these fraudulent accounts constitute involuntary servitude, a violation of the Thirteenth Amendment to the United States Constitution.
Color of Law and Deprivation of Rights The actions of your organization and its agents have been carried out under the color of law, which is the appearance or use of lawful power to mask an illegal act. By using government authority to access and control my financial information without my consent, your organization has deprived me of my inalienable rights, in violation of 18 U.S.C. 242.
Provisions and penalties for negligent violations are provided under section 617. [ 15 U.S.C. 1681o ]. Any person who demonstrates negligence by failing to comply with any requirement established under this law concerning a consumer is responsible to the consumer for an amount comprising : 1. Any actual damages incurred by the consumer due to the failure ; and 2. In the event of a successful legal action to enforce any liability, the costs associated with the action, as well as reasonable attorney 's fees determined by the court.
False Pretenses The law deters fraudulent activities and cases done knowingly under false pretenses. The FCRA penalizes anyone who obtains consumer information from the CRA under false pretenses. As specified under the United States Code, the conduct is punishable by a fine, imprisonment for up to 2 years, or both.
Unauthorized Disclosure Under section 620. [ 15 U.S.C. 1681r ] of the FCRA, any officer or employee of the consumer reporting agency who knowingly or willfully provides consumers information from the agencys files to any person not authorized to access the information shall be fined or imprisoned for not more than 2 years or both.
1. Furnishing and Reporting Old Information Credit reporting agencies and the creditors who supply information to them must provide and keep your credit information current. When your credit circumstances have changed, and the information in your credit report isn't updated to reflect these changes, this failure might be an FCRA violation.
Some examples of this kind of FCRA violation include : failing to report that a debt was discharged in bankruptcy XXXX XXXX XXXX XXXX XXXX reporting old debts as new or re-aged XXXX XXXX XXXX XXXX XXXX reporting an account as active when it was voluntarily closed by a consumer and reporting certain information XXXX XXXX XXXX XXXX XXXX that's more than seven years old ( like lawsuits ) or ten years old ( XXXX XXXX bankruptcies ).
2. Furnishing and Reporting Inaccurate Information Your creditor must not supply information to a credit reporting agency that it knows ( or should know ) is inaccurate. That kind of information includes : reporting a debt as charged-off when you settled it or paid it in full misstating the balance due reporting late payments when you paid timely listing you as a debtor on an account when you were only the authorized user or supplying credit information on an account where identity theft was previously reported ( or failing to maintain a reasonable procedure for you to report identity theft XXXX XXXX XXXX XXXX XXXX ).
Credit reporting agencies must not include inaccurate information in your credit reports.
3. Mixed Files Credit reporting agencies can also run afoul of their obligations to report accurate credit information about you. In many instances, this violation happens when a credit bureau mixes your file with someone else 's file with similar background information.
Some common cases of mixed files include : morphing or duplicating negative credit information with a stranger who shares a similar Social Security number failing to distinguish the Jr. and Sr. in similar surnames mixing the information of persons with the same last name and similar first names, and combining or mixing credit files of persons with similar names living in the same city or zip code.
4. Failing to Follow Debt Dispute Procedures When you submit a written dispute about the accuracy of an item on your report XXXX XXXX XXXX XXXX XXXX, the credit bureaus and your creditors must take certain actions in response. Their duties include conducting a reasonable investigation of your dispute, correcting any inaccurate information, or even removing the disputed debt from your credit reports.
A credit reporting agency or creditor can fall short of its duties to follow proper dispute procedures under the Fair Credit Reporting Act in a number of other ways.
Debt Dispute Violations by Credit Reporting Agencies Some common FCRA violations by credit reporting agencies include failing to : notify a creditor that you dispute the debt that it has reported conduct a reasonable investigation of your dispute or correct or delete any inaccurate, incomplete, or unverifiable information within 30 days ( or 45 days in some cases ) of receiving notice of your dispute.
Debt Dispute Violations by Creditors and Other Information Suppliers Some common creditor and furnisher FCRA violations XXXX XXXX XXXX XXXX XXXX include failing to : notify every credit reporting agency involved that you dispute the debt submit corrected information to the credit reporting agency subsequent to investigating your dispute refrain from continuing to submit information that it knows ( or should know ) is incorrect conduct an internal investigation of your dispute within 30 days ( or 45 days in some cases ) provide you with a reasonable procedure, including an address, to submit a written dispute or report of identity theft or inform you of the results of its investigation within five business days after it completes the investigation.
5. Privacy Violations Credit reporting agencies can't release your credit reports to just anybody. They can only give them to authorized persons. The agencies may disclose your report only to persons or entities that have a valid need, such as : creditors landlords insurance providers utility companies, and employers ( only if you previously consented ).
6. Requesting a Credit Report for an Impermissible Purpose Even though your employer, creditor, or landlord might be allowed to pull your credit report, they must still have a permissible purpose XXXX XXXX XXXX XXXX XXXX to do so. If someone pulls your credit report for an impermissible purpose, then it might be an FCRA violation.

In XXXX, I overdrafted an account, XXXX, with Trustmark National Bank. The ovwrdrafted amount was aprox XXXX dollars. Truatmark aprox. One year later relayed the debt to lawyer, XXXX XXXX. I was sued and the judge awarded in Trustmark National Bank 's favor. XXXX attempted to seize funds from a new account I opened at XXXX XXXX XXXX. XXXX XXXX did Not authorize the transaction, so the XXXX account was in deficit for days, and then the transaction was revoked and my account went back to normal. Trustmark Bank 's lawyer, XXXX XXXX, still had not received payment. I told her, XXXX, to stop calling my phone number, she was very rude.
Fast forward from XXXX to XXXX, I check my credit report on XX/XX/XXXX, and Truatmark National Bank has posted a credit inquiry that i DID NOT authorize. I called Trustmark 's 1800 number I was then directed to a XXXX XXXX. I contacted her, leaving voice mail until I received a call back on, XX/XX/XXXX. XXXX XXXX ( XXXX ) asked for my personal info, and after that she directed me to a, XXXX XXXX within Trustmark 's XXXX. XXXX XXXX told me on XX/XX/XXXX that I needed to call XXXX XXXX, in reference to my past due debt.
XXXX stated that Trustmark can do credit inquiries any time as a stipulation of my debt. I was also told by XXXX that the only way to remove this inquiry was to contact XXXX XXXX. I asked XXXX why wasn't this debt charged to a collection agency and listed, as such, in my credit report. I was told again to contact XXXX XXXX, Trustmark 's lawyer Essentially I have a past debt with Trustmark National Bank. I have verbally stated to not be contacted, I have told lawyer not to call my phone. Each time u speak with a creditor it re-initiates the process of debt, Trustmark National Bank is performing unauthorized credit inquiries using my name and information.

My bank accounts at Trustmark bank have been compromised. I have sent a complaint concerning one of my checking accounts and I need to add the other " High-Yield " account as well. I have attempted to reconcile these matters with the bank, on several occasions without any resolution. I am a victim of Identity Theft which I reported to the FTC. I have also reported the bank account breaches to the FDIC. My E-mail has been compromised. I have never had an internet account for any of my banking accounts. I never use on-line banking.

Initially a construction loan through Trustmark National Bank ( land owned by us ) when we finished building the bank strong-armed us into an in-house loan product with a balloon paymnent due in 7 years. It was never explained to us why we were given this type of loan or why we didn't qualify for a conventional loan. We had qualified through another local bank for a FHA loan but went with XXXX due to our builder recommendation. We had a modification due to loss of job and this is when we learned of the in-house loan and not a FHA loan. I had applied for several federal programs to assist us since I was going back to school for XXXX but they weren't available to me due to our loan type. Even when the modification was given it was never explained to us that we had a balloon payment loan.
I feel that we have been unfairly targeted because of race.
Also, the current balance has increased to more than what we initially borrowed for the mortgage and this is after almost eight years of mortgage payments.

My checking accounts at Trustmark Bank have been compromised. A great deal of money has been stolen from each account. There are multiple debit card transactions that are inconsistent. There are also internet banking accounts that I did not authorize. I never use internet banking. In addition, I strongly believe there are several debit cards that were issued to others without my authorization. I am a victim of Identity Theft. I have a claim/case with the FTC.

The insurance company that was available for me based on my budget was rescinded once documents was in place the insurance company underwriter ruled us ineligible for insurance based on the condition of the home it was because of Electrical and Plumbing problems I have attempted to get this resolved but been ignored I recently filed a complaint with the realtor association I was advised that my complaint was with the bank and the appraiser the representative from the insurance company came out once we the loan documents was completed we moved into the home not knowing whether or not the insurance would be accepted I feel that the process of the loan being close should have been on hold pending the insurance inspection but the day we where in the home a few days after the loan originator had me signing the documents the insurance company sent someone to the home and a few days later we got a letter and a Email stating that we where ruled ineligible for insurance and this was an FHA loan and now because of this problem I have Electrical Problems and Plumbing issues there are many problems with this home my credit is damaged because of the Electrical issues I have 15 feet of water these problems especially with the denial of insurance created the problems for me it is leaking water real bad I have video and proof of these issues nobody is trying to help me the loan was close without any insurance and the bank for me to take there insurance because I didn't have any it's not fair when I inherited these problems and the underwriter rule us ineligible because of the condition which the underwriter listed the pics o have attached pr water damage from the issues stated in the rescinded policy it actually is worse than that I have pic documents.
