Consumer portfolio is saying my account is a charge off. There was not XXXX consecutive months without a payment. The vehicle was total the insurance company paid. They asked me to pay a little on the account which I am doing. But when you calculate me paying for a vehicle for XXXX XXXX years at XXXX. With XXXX payment deferred and insurance paid XXXX in XX/XX/2022 should not be showing a negative mark on me.

This is attempt # 3 that includes new and updated information regarding the improper use of my credit report. I have reviewed the original alleged contract and have found several discrepancies that include some of the following : 1 ) Consumer Portfolio Services does not have written or verbal consent to report to any consumer reporting agencies. This is a violation of my privacy. 18 U.S. Code 1028A ( a ) ( 1 ) 2 ) XXXX illegally and knowingly collected a down payment amount of XXXX while also collecting financing for the alleged contract agreement. 15 U.S. Code 1605 ( a ) 3 ) Reporting my account as " paid by insurance '' on my credit file as ANY mention of me having insurance is in violation of 15 U.S. Code 1681a ( i ) ( 2 ) 4 ) The alleged contract agreement has several financial discrepancies which includes miscalculation of total charges and payment amounts.
I am attaching the portion of the phone conversation where the XXXX representative made a motion to resolve this issue. I am requesting the following remedies : 1 ) deletion of this credit account from all of my credit files.
2 ) a letter confirming the deletion of this account from all credit reporting agencies.
3 ) Reimbursement of fees which shall include the down payment, late payment fees, recalculation of accurate finance charge, and any fees to remedy for pain and suffering.
-Two separate payments must be provided to account for the illegal and predatory acts taken against my wife and myself.

I sent a picture of my drivers license to my brother XXXX, he was in the process of trying to get a vehicle. The sales representative that we spoke with explained to us that since I wasnt co-signing on a vehicle that they didnt need to run my credit, I was confused with that information because if that was the case then why did they need me to probide anything on his behalf. I beleived the representative and provided my license and the very next day I began to receive notifications from credit karma that I had 6 new inquiries on my report in which I never consented to regardless of who it was from.

About XX/XX/2022 all of my credit monitoring apps went off to inform me of my credit score dropping over XXXX points because of consumer portfolio. Money payment was made and they still reported me being over 30 days late. I called the company later that day and they said sorry. Nothing that the was going to.do to fox their mistake. I just got my credit score higher. Now they ruined it. I want that later payment removed and my credit score fixed.
