this is a followup to case # XXXX. When they found out I complained to you, they had a lawyer send me a letter about this complaint. Apparently I am being sued for filing a complaint with you. It didnt say in the letter any legal action was pending but why else would they hire a {$250.00} an hr lawyer to write me a refutation of my complaint.

Around XX/XX/XXXX, I received a phone call from Collections, Inc. ( XXXX was the name I was given ). I discussed with her via phone call about an outstanding medical debt that she says was from XXXX and XXXX. She claimed I had a defaulted payment agreement with the hospital but I've never set up a payment plan with the hospital. She threatened to garnish my wages and even called my jobs two days later to verify I worked there. I answered the work phone and then called her back on my cell phone. That same day, a payment agreement was met between myself and Collections , Inc via phone call with XXXX. She advised that in XXXX I would make a payment on XX/XX/XXXX ( my payday ) and every payday thereafter until my balance was paid in full in the amount of {$170.00} per payment. I agreed to this. On XX/XX/XXXX, a payment was drafted in the amount of {$170.00} and I assumed all was good. On XX/XX/XXXX, when the second payment was set to be drafted, she called and advised I was in default of my payment agreement because I had not made a second payment in XXXX. I then discussed with her via a recorded call on my cell phone how I was advised I would make these payments on each and every payday until the balance was paid in full. I was still authorizing the {$170.00} to be paid on XX/XX/XXXX, but I could not double up as I had not been prepared to do so. She advised I was then defaulted and fees and garnishment would continue. I asked how can you default a payment agreement when you are agreeing to pay what you owe on the dates previously agreed upon. She stumbled over words and I asked if this statement about me having to make a second payment in XXXX was recorded and she said " It's in my notes. '' I asked if it was recorded and she replied, " No, we do not record phone calls, we would be required to tell you if we did. '' I said, " Okay, that's fine because I am recording this phone call for my records. '' She immediately replied, " Then we can no longer speak, have a great day. '' and disconnected the call. I do not understand how this is legal debt collection practice when they have no agreement from anyone in writing or via recorded call and when you try to make it right, they refuse to work with anything you offer unless it's what they want.

Lady from collections inc named XXXX has called me excessively, yelled at me, and is threatening me saying the papers to sue me on her desk she is turning in because I won't pay. I have asked multiple times for an itemized statement of debt or debts owed and she says she doesn't have access to that. I told her there is a statue of limitations on debts and that she has no right to speak and yell at me and to keep threatening me. I have been nice and she is wrong and violating my consumer rights and fair debt collection practice act.

I was contacted by Collections, INC. with two accounts that were open with them from XXXX XXXX in XXXX, MS. One account was sent to the Justice court and one had just gotten to their agency. The first account was originally {$1200.00} and some odd dollars, but with court and attorneys fees, it went up to over {$1600.00}. I paid that total in full to stop the court proceeding. I also paid {$740.00} towards the other account. The Account is now down to a little over {$3000.00} and when I tried to set up a payment arrangement, they are saying that I need to pay over {$400.00} a month. If I did not pay it in full or pay the {$400.00} a month that they would garnish my wages and that my credit would be ruined. I can not pay that amount and continue to pay my other bills. I told them I would give them {$100.00} a month and that they could draft it out of my account. The agent went on and on about how that isn't enough. I gave her my debit card information and set up the plan after a lengthy back and forth. Then, two minutes later, she called back saying that " legal '' walked by, and is not excepting this arrangement and that I would have to pay more. So, they do not want to except my automatically drafted arrangement, and want to garnish me? How could this be right or just? I XXXX my ankle and had XXXX XXXX and XXXX XXXX put into it. I am just getting back to being normal, because this happened in late XXXX and it is XXXX Now, I am being harassed by a company that refuses work with me at all. Who can come up with {$400.00} extra a month being single and having living expenses? I have seen many other complaints on the XXXX website where this company offered others arrangements for {$50.00} to {$100.00} dollars a month, and it is obvious that they pick and choose who they want to work with.

a ) they never sent us any letter with their name, address and account number. They insisted on calling me at work.XXXX for a living thats totally unreasonable. I asked them to talk to my wife because she is home during the day. They threatened garnishment even though garnishment is XXXX dollars and I only owe $ XXXX.I told them I can not pay the whole amount and needed a payment plan and she said she wanted my debit card number. This was without telling me who she even was and with no way to keep them from taking the whole amount. I said no I 'll send a check for what I can afford. She said she had to have the whole amount. Whenj I said I couldnt afford the whole amount she said I was being rude and hung up.She continues to call me while I am at work XXXX.

I was contacted by Collections Inc. on Thursday and was told that they were attempting to collect a debt. I told the representative that I need to take a number and call them back. I was told again that this was an attempt to collect a debt and who the original debt was with. The representative never disclosed where they were calling from and then proceeded to threaten that legal action will be taken by XXXX. the next day. I was also told that they were planning to garnish my wages. I 've never received any letter from this company or phone calls before XX/XX/2017. On XX/XX/XXXX I contacted the company to find out the name and the rep refused to give me their name without verifying my address. I 'm not sure why it was okay to discuss the account with me during the previous call without verifying my address, but they ca n't share the name of the agency without confirming my address. I requested information to verify the debt and was given some information over the phone and was told that I could be provided the account history from the original account holder. I find it disturbing that I was threatened with garnishment the first time the agency contacted me and was n't allowed the 30 days to confirm or dispute the debt. I was told that my file was referred to the legal department. The representative was very unprofessional and rude. She seemed to take pride in the ability to garnish wages. This company uses bullying tactics and preys on the ignorance of others concerning the law to administer unlawful collection practices. They need to be held accountable and so does the Hospital that chose them as a third party service provider.
