(a) Backside of the building - On or about May 28, 2015 employees were exposed to a struck by hazard while passing and laying cinder blocks without wearing hardhats. None of the employees were wearing hardhats. |

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) Backside of the building - On or about May 28, 2015 an employee was exposed to a fall hazard while working in a Genie S65 Boom lift Telescopic Boom Lift. This employee was elevated 9 feet 9 inch above ground without fall protection. (b) Roof of the building - On or about July 1, 2015 an employee was exposed to a fall hazard while working in a Genie S65 Boom lift Telescopic Boom Lift. This employee was elevated 15 feet 4 inches above ground without adequate fall protection. This employee was wearing a harness but there was no lanyard attached. |

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. (a) Roof of the building - On or about July 1, 2015 two employees were exposed to a fall hazard while working on a low-slope roof without adequate fall protection. These employees were 13 feet above the ground. One employee had on a harness the other did not. Neither employee was tied-off. |

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a) El Sombrero - On or about May 28, 2015 the employer did not train each employee exposed to various hazards associated with construction on how to recognize and minimize these hazards. The employer did not provide training to help employees avoid unnecessary injuries on this construction site. The employer stated he did not provide any training to his employees. 1) Employees were not provided with hardhats. 2) Employees got on a roof without fall protection. 3) Employees did not wear harnesses inside an aerial lift. 4) Employees did not have first aid training or know procedure for receiving medical attention. |

Regulations prescribing specific requirements for first aid, medical attention, and emergency facilities are contained in Subpart D of this part. (a) El Sombrero - On or about May 28, 2015 the employer did not provide first aid training or a first aid kit to his employees and employees did not know the location of the nearest medical facility. |
