XXXX XXXX XXXX 2020 XXXX XXXX, XXXX XXXX Southern Financial Systems XXXX XXXX XXXX XXXX GA XXXX RE : Account # {$1200.00} To Whom It May Concern : This letter is being sent to you in response to notices sent to me from your company and more importantly, due to your erroneous reporting to the Credit Bureau { s }, the highly negative impact on my personal credit report. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 { b } that your claim is disputed and validation is requested.
This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above-named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

i sent them a letter disputing the validity of the alleged debts on XXXX by XXXX certified mail XXXX XXXX XXXX XXXX 1989. I never received my documents per XXXX XXXX XXXX and XXXX XXXX XXXX, which is a violation of the FDCPA.

I am unsure of the debt and its amount. I have not received a notification to initiate a dispute for this information to receive verification required by 809 ( a ) of the Fair Debt Collection Practices Act.
Under 809 ( a ) ( 3 ) of the act, the company must notify me that " unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ''. I have not received the notice, and I need it for my 30 days. Regardless of when it was mailed out, it is affecting my credit report and I want the written notification required under the FDCPA to dispute the debt and request validation of this debt that.

Southern Financial System, a collection agency that is handling my account.
The events in question are outlined below : Timeline of Events : - XX/XX/XXXX : I received a summons to appear in court. This was the first and only attempt made by Southern Financial System to collect on my account.
XXXX XXXX, XXXX : I learned that Southern Financial System received my account in XX/XX/, and it was held for six months without any attempts to collect.
Violations and Concerns : 3. Fair Debt Collection Practices Act ( FDCPA ) Violation : The initial communication I received was a summons to appear in court, a direct violation of the FDCPA.
4. Hospital 's Collection Procedure Violation : Southern Financial System 's actions also contravene the hospital 's collection procedure, which says attempts to collect in full or set up payment arrangements on the account. I was never given an opportunity to set up a payment arrangement.
5. Lack of Collaborative Approach : It is evident that the primary focus of Southern Financial System appears to be pursuing legal judgments rather than working collaboratively with patients to resolve accounts.
XXXX. Unprofessional Conduct of XXXX ( XXXX ) : During my attempts to address these issues with XXXX, the owner, I encountered extreme rudeness and unprofessional behavior. She refused to provide a copy of the collection policy when requested, declined to answer questions, hung up on me twice, and took over calls when others attempted to convey information about their attempts to collect on my account. Her response was dismissive, stating, " It does not matter because you owe it. ''.

Southern Financial came up on my credit report. I made contact with the company seeking full proof as to why they had this listed. I sent this letter certified mail which was signed by a XXXX on XXXX XXXX,2017. After not receiving the validation I sent Southern Financial another certified mail letter stating that false reporting is illegal and not responding to the request was also prohibited. On Thursday XXXX XXXX, 2017 Southern Financial sent a stack of papers. I received documentation that included the detailed list of medicines, codes, tests, and etc. I am aware that this collection agency is in COMPLETE HIPAA VIOLATION. This company intentionally violated my rights under the FCRA law as well as HIPAA. I previously had asked for total validation and they did not comply.

Complaint What Happened |
This is just a follow up complaint about Southern Financial Systems. This complaint it to show that Southern Financial Systems is aware that the debt is fraudulent and yet they still report the debt to credit bureaus. I spoke with the original creditor, XXXX XXXX, and sent them the documentation they requested to confirm fraudulent activity. The XXXX XXXX collections representative, XXXX XXXX, confirmed receipt of the documentation and forwarded it to XXXX so that Southern Financial Systems can be aware that fraud has taken place. Ive given Southern Financial Systems over a month to remove the debt from my credit files since they now have proof that my signature was forged. I also explained to XXXX that the address where I lived is family land and is shared by 3 households. XXXX understood this and acknowledged how easy it would be for someone to tamper with my mail. I tried to explain the same situation to XXXX but she would continuously cut me off to avoid hearing the truth. Southern Financial Systems has willfully neglected their duty by federal law to remove the debt. This debt from ambulance services that Southern Financial Systems is claiming I owe was made with with another debt from XXXX XXXX in XXXX, MS . When XXXX XXXX tried to collect the debt from me for the hospital services accrued from the person who committed fraud, I was able to dispute the debt and the collection agency immediately deleted the debt because they had proof of fraud. I have in writing that the hospital debt was considered invalid and deleted immediately. However, XXXX of Southern Financial Systems is operating from a place of greed and lack of a moral compass. I have attempted to settle this without seeking legal intervention but XXXX refuses to follow federal law because for some reason I believed that this woman was noble enough to see an invalid debt and delete it. But XXXX is fully aware of the invalidity of the debt and still continues to report to the credit reporting agencies. I think that XXXX feels she is bigger than the law. Im submitting this complaint so that it can be posted publicly for others to be aware of the criminal activity that is exercised by XXXX and Southern Financial Systems.

Complaint What Happened |
I recently obtained a copy of my credit report and noticed Southern Financial Systems Inc furnished information on my credit report. The item states that they opened the account in XX/XX/2018. I have never received an initial communication in writing that is required by federal law. Because of their lack of following proper procedures, I was unaware of the debt they claim I owe and was never given the opportunity to exercise my right to dispute the debt within 30 of the initial notice. Southern Financial systems began reporting this debt without my knowledge and without verifying the debt. I do not believe that the debt belongs to me. I would like for them to properly verify the debt by providing the original consumer contract with my signature on it. Without that, there is a strong possibility that Southern Financial Systems has mistaken my identity for someone elses. And by their lack of following the federal law to send notification about the debt, I assume that Southern Financial Systems knows that they can not verify the debt and are illegally furnishing information to my credit files. I would like to exercise my rights and demand to have the debt validated and verified or immediately deleted from all credit reporting agencies.
