OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that there were no seatbelts provided on the Caterpillar V-80-E Forklift being used to load dry lumber; nor was there a proper operator's seat-back provided. (a) Dry Lumber Storage (chicken) House to Yard where trucks are loaded - On or about December 13, 2012, employees were exposed to being crushed while operating the Caterpillar V-80-E Forklift, should it overturn, due to the absence of a seat, with seatbelts, conforming to the manufacturer's original design specifications.
