Citation text line OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards while working at or near dust collection system which were not adequately designed to prevent or minimize employee exposure in the event of a deflagration or other uncontrolled fire event: (a) Powder coat room - On or about November 5-6, 2015, in the North powder coat room for tillers, the employer had not performed applicable evaluations such as but not limited to; Process Hazard Analysis, Performance Based Design, Facility and System Design, and Risk Evaluation on the powder coating room and powder coating systems containing Class II combustible dust for deflagration/explosions controls. Combustible dust was found on ignition sources located on the walls and the process equipment. (b) Powder coat room - On or about November 5-6, 2015, in the South powder coat room in plant 2, the employer had not performed applicable evaluations such as but not limited to; Process Hazard Analysis, Performance Based Design, Facility and System Design, and Risk Evaluation on the powder coating room and powder coating systems containing Class II combustible dust for deflagration/explosions controls. (a) Upper handle bar press - On or about November 5, 2014, the blue manufactured Below-the-Hook lifting device, used to lift 3340 lb. bundles of metal tubing had a blank label and was not marked or had an inspection plate which listed the information below. The label listed the name of the manufacturer. (b) Lower handle bar press - On or about November 5, 2014, the yellow Below-the-Hook lifting device built by the employer used to lift 1675 lb. bundles of metal tubing was not inspected, tested, and marked with the information below. (c) MOO 2 lower handle bar press - On or about November 5, 2014, the orange Below-the-Hook lifting device built by the employer used to lift 2092 lb. bundles of metal tubing was not inspected, tested, and marked with the information below. - Rated load [as described in para 20-1.2.1(a)] - Manufacturer's name and address - Serial number of the device - Lifter weight if over 100 lbs. (45 kg) - Cold current (amps) and rated voltage (if applicable) - ASME BTH-1 Design Category and Service Class Reference ASME B30.20-2006, Section 20-1.2.1 Marking and Section 20-1.3.8 Testing MTD Consumer Group Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 5a1, which was contained in OSHA inspection number 313783235, citation number 1, item number 2 and was affirmed as a final order on August 6, 2010, with respect to a workplace located at 979 South Conwell Avenue in Willard, OH 44890.
