None of these employees were wearing protection eye wear. The employer did not enforce the wearing of safety glasses on this jobsite.

Citation text line 29 CFR 1926.304(d): Guarding. All portable, power-driven circular saws shall be equipped with guards above and below the base plate or shoe. The upper guard shall cover the saw to the depth of the teeth, except for the minimum arc required to permit the base to be tilted for bevel cuts. The lower guard shall cover the saw to the depth of the teeth, except for the minimum arc required to allow proper retraction and contact with the work. When the tool is withdrawn from the work, the lower guard shall automatically and instantly return to the covering position. (a) Front of the house - On or about February 22, 2017 an employee was exposed to laceration and amputation hazards by using Skil Circular Saw without the guard in place. The saw was blocked by a small piece of wood. The employees using the saw were exposed to the blades during the cutting process because the lower saw guards were intentionally blocked out of place. Therefore the guards could not automatically and instantly return to the covering position.

Crossbraces shall not be used as a means of access. (a) Left side - On or about February 22, 2017 two employees were exposed to a fall hazard while climbing on a wooden fabricated scaffold 8 feet above ground with no ladder installed. There was also uncapped rebar underneath the scaffold platform.

(a) Plan & Build, LLC - On or about February 22, 2017 the employer did not train each employee exposed to various hazards associated with construction on how to recognize and minimize these hazards. The employer did not provide training to help employees avoid unnecessary injuries on this construction site. And employees demonstrated an in ability to work safely. 1) Employer did not enforce the wear safety glasses while cutting materials. 2) Circular saw guard was blocked causing the blade to be unguarded. 3) Employees were working on scaffolds without fall protection. 4) Employees were working on a scaffold without no ladder attached. 5) Employees worked above uncapped rebar.
