(a) Downing Court Apartment Building No. 1 - On or about December 9, 2015, subcontractor employees accessing ladders between floors and the roof from the second and third floor balconies of Building #1 were exposed to falls to the ground of 10 feet 9 1/4 inches and 21 feet 6 1/2 inches respectively due to the absence of standard guardrails along the unguarded, open-sided proposed second and third floor balconies. (b) Downing Court and Taylor Court Apartment Buildings - On or about December 9, 2015, subcontractor employees working on the second and third floor balconies of Downing Court Building #1 and Taylor Court Building #2 were exposed to falls to the ground of 10 feet 9 1/4 inches and 21 feet 6 1/2 inches respectively due to the absence of standard guardrails along those unguarded, open-sided proposed second and third floor balconies. |

Instead, employees were wearing rock-climbing waist harnesses and occasionally tethering to a small diameter lifeline without utilizing shock-absorbing lanyards as they moved about the roof. |

Citation text line | 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) Downing Court Building No. 1 - On or about December 9, 2015 three subcontractor employees accessing the roof from a 12 foot aluminum extension ladder situated on the east end of the third floor balcony of Building #1 were exposed to falls to the ground of 21 1/2 to 30 1/2 feet due to the top of the ladder only extending about 1 foot above the upper landing, instead of at least 3 feet above the upper landing. It was secured against displacement. |
