XXXX XXXX XXXX has closed my loan. Shellpoint has undisclosed policies. They took my payment and put it towards the home principal without disclosing the information. In XXXX I paid approximately XXXX. I asked the guy prior to making the payment will my monthly payment go down if I pay {$5000.00} towards my escrow he stated yes. I checked the portal days later my payment did not go down as he stated. It was left in my escrow acct the house payment was the same. I called and asked is the call recorded the guy stated yes. I told him the problem he stated your escrow analysis isnt until XXXX or XXXX. I said I was told that previously. I requested the {$5000.00} be put towards six payments. He said ok you will not have a payment until around XXXX or XXXX. I checked again days later the problem still is not solved. I called again spoke to a lady. I asked are the calls recorded she stated yes. I told her the problem she stated she fixed it and apologized. I received a letter stating XXXX XXXX XXXX own my loan. My loan was supposedly bought out by Shellpoint in XXXX and Shellpoint is the company I have been paying. Theres no record of Shellpoint on my credit report and XXXX XXXX XXXXXXXX has me owing XXXX. This is stressing me out causing me to under perform on my job. I feel as though my acct is fraudulent and will like a complete paid in full acct with the clean deeds sent to me mental distress compensation from which company is playing whatever games. I have the letter at home where Shellpoint stated XXXX own my loan but Ive been paying Shellpoint.

I requested an escrow analysis in XXXX of XXXX. I have a surplus of {$1400.00}. On XX/XX/XXXX, I asked to receive my surplus funds back from the analysis. The lender tells me I am late because I owe for XX/XX/XXXX. It is my understanding. I have 30 days to make my loan payment. We were working in the month of XXXX. They denied my request. Now they are reporting to the XXXX credit bureaus that I am 30 days late on my payment. Which has caused my credit score to drop XXXX points. The reason the loan was transferred is because the previous lender. Was in a class action lawsuit over this matter and had to close their doors.

Since 2001, we have always paid the insurance and property taxes for our property outside of the our monthly payment to the mortgage company. We have never authorized and/or approved a servicer controlled escrow account for the purpose of paying property taxes and hazard insurance for the subject property. However, when Shellpoint became the servicer for the loan, an escrow account was set up and PITI was placed on the property, even though we already had insurance on the property a. To be clear, we NEVER authorized an escrow account and had assumed responsibility for payment property taxes and insurance outside of payments made towards satisfying the principal balance mortgage under the terms of our Deed of Trust.
Shellpoint has now increased the our monthly mortgage payments and claim that we owe an " Escrow Only '' payment of {$4000.00}. To be clear, when shellpoint place insurance on on our property, we already had insurance, so there were two insurance policies on the property at the same time as a result. Further, we have never had or authorized an escrow account. We do not believe that we should be responsible for payment of a duplicate policy, that we never authorized or had any knowledge of until after shellpoint had placed the policy on the property.
I hired an attorney for the specific purposed of drafting and sending a letter to Shellpoint regarding this matter and in an attempt to resolve this matter. I have not yet retained an attorney for the purpose of filing suit against Shellpoint and this is my final attempt at resolving this matter before doing so.

In XX/XX/2018 I called shellpoint to let them know that my husband was gon na be out work for 3 weeks and without pay. The guy I talked to said that was fine all I had to do was to spread out the month of XXXX over a 6 month period and my payments were XXXX at that time. So my payments would go up to XXXX a month starting at the beginning of XXXX. I said that would work. He referred me to someone to set that up. I called and left messages and no calls for several days. When I got the call it was after the XXXX and now Im 2 months behind. So to get my payments below XXXX. I had to pay XXXX. So I did. Now, she was suppose to call me the next day and did not. So when I received a letter in the mail showing my new payment of XXXX a month it was after the date of getting it done. So I went online to set up a 2 month payment in XXXX. Then, something told me to call so I did. When I called the lady I talked to told me it was all set up and all I had to pay was the XXXX. I was relieved. So I set the payment up for XX/XX/XXXX. I thought everything was fine. Then I get a call on XX/XX/XXXX saying they r attempting to collect a dept. I call her back the next day and she tells me they didnt receive the payment. Now it has been 3 weeks since the payment was suppose to come out. I have a confirmation number and a 2 letters confirming all of this. She said that it didnt matter and now to get my loan current I have to pay XXXX. Excuse me??!! Then she says if I can make 2 payments adding up to XXXX that would work and then for 6 months my payment would be XXXX and if I pay the fee of XXXX for someone that drove by to take a picture to prove I am still living here it would bing my payment down to XXXX. I tell her I can only pay XXXX. She says ok. Now my payments are gon na be XXXX a month. This is not right or fair. I called for help in time and now 3 months later my 6 month payment has gone fromXXXX to XXXX. There is something wrong with this picture??!! I believe they r giving me the run around to get more money out of me or something. I have received certified letter saying I have 45 days to comply as of today XX/XX/XXXX. What am I suppose to do. I dont want to lose my home we have been here for 23 years. Help me please.

XXXX made an electronic payment from my checking account for {$380.00} for a monthly payment. As of this date, Shellpoint Servicing have NOT applied this payment ; and I have shown proof where the money was taken from my account. NO RESPONSE YET!
XXXX made an electronic payment from my checking account for {$380.00} ( Regions Bank ). Shellpoint is NOT showing where this was taken from my bank account.
XXXX received an email saying the payment was late and had not been received. I immediately tried calling the office ; as usual, no answer. Left over 7 messages ; no reply as of XX/XX/XXXX.
XXXX made another payment of {$380.00} so my account would be up-to-date and hopefully won't be charge a " late '' fee. In turn, I went to the bank and now I have " DOUBLE '' paid, and Shellpoint Servicing is only showing receipt of ( 1 ) payment instead of two payments!
I am so sick and tired of this company. I have sent emails over and over and over and I NEVER receive a reply. I call and call and call, leave messages and NOBODY ever calls me back! This is poor, poor customer service!
I am requesting a complete summary of ALL payments made to Shellpoint Services from XXXX, XXXX, XXXX. I also need a summary of payments made to Shellpoint XXXX from XXXX, XXXX, XXXX. I double PAID for the month of XXXX because I received a late notice, and when I checked both of checking accounts, ( XXXX ) payments were taken from my checking account!!!!! I have my proof from both banks!
I would appreciate it if you could get this information for me because I can NEVER speak and when I leave messages NOBODY call me back. This is so wrong.

Received letter from foreclosure attorney with sale date for my property XXXX.
Foreclosure Letter dated XX/XX/2022, postmark envelope XXXX/XXXX/202. Requested from my mortgage servicer recently, and several times, additional time on a forbearance. I was told I could not get a forbearance because I had a previous forbearance of which I found out was not true. Shellpoint customer service has given me misleading information and they are trying to make me lose my house to foreclosure. My research I found I could have a forbearance up to 18 months under the Covid -19 or Hero Act. In my mortgage documents I signed at closing it states I was to be given 30 days prior to foreclosure sale date, of which I was not given. My mother who is elderly was affected by XXXX she now has terminal health issues from XXXX. I was affected by XXXX my employer closed the business where I was employed, I lost my employment and I had XXXX too. Submitted financials and all requested information for mortgage assistance, I have not received a denial letter for mortgage assistance or my request for a forbearance. I have not received a letter from foreclosure attorney asking me to validate the debt I have made a request. Shellpoint customer service is rude, and I was told that I needed to sell my house because I could not afford it. I feel I have been discriminated against because I'm a XXXX female and a Senior Citizen.

NEWREZ, LLC dba SHELLPOINT MORTGAGE SERVICING has continued to ignore my instructions to settle the account and issue a satisfaction upon the margin of record with my county recorder of deeds. I have issued several instructions for NEWREZ, LLC, SHELLPOINT, and their XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX to use the available credits held by the XXXX to balance the XXXX and XXXX accounts in order to reconcile both sides of the ledger. This was a credit transaction according to TILA and I demand that my equitable rights pursuant to the Dodd-Frank Act be honored. I have equitable rights to recoupment and sett-off. The initial instrument which was tendered by my Estate is the security that funded the entire transaction. TILA demands full transparency in all consumer transactions. Due to the non disclosure of the intentions of the initial holder of the note XXXXXXXX XXXX XXXX XXXX XXXX who contracted XXXX XXXX XXXX to be the intermediary institution to maintain the account ) to hide my status as Donor of the notes that I would not know that I had satisfied the obligation with my signature that gave the note value. Pursuant to Regulation Z I was never given the disclosure documents informing me of my right to rescission and the accompanying forms to submit. This is why I have issued NEWREZ, LLC a notice of Adverse Claim and a Notice of Rescission. The notice was delivered to their corporate office, and copies were sent to SHELLPOINT 's correspondence address. I have attached copies of all documentation and proof of delivery. To make matters worse I brought the correspondence to the attention of NEWREZ, LLC CEO XXXX XXXX and the XXXX XXXX XXXX. My notices have still been ignored.
The receivables ( XXXX account ) was sold on the market to XXXX XXXX who now claim to be the owner of the note and are currently holding it in XXXX XXXX XXXX. The problem I have with this transaction is that I'm a non disclosed third party investor to the pooling and servicing agreement which gives me priority claim and possessory rights to the note and all of its proceeds. Only a holder in due course can enforce the note. This means XXXX XXXX along with NEWREZ, LLC took the note subject to my claims. It is impossible for XXXX XXXX to be the holder in due course. The fact that I have a claim to the note gives me the authority to instruct NEWREZ, LLC dba SHELLPOINT MORTGAGE SERVICING to perform their fiduciary duties and have the Bailee set-off the receivables ( XXXX account ) side of the XXXX with my payables ( XXXX account ) side which are the credits held with the XXXX. I have proof of endorsed payment coupons which were to be used to redeem my credits. I will not continue to allow SHELLPOINT to violate my rights and continue to use unfair debt collection practices to force me into peonage for the unjust enrichment of themselves and the Investor/Owner Bank XXXX XXXX XXXX I have also tendered the endorsed note with instructions to settle the account. SHELLPOINT has stated that they do not know what to do with negotiable instruments nor securities. This is a false statement which is evidenced by their response to my privately issued Bill of Exchange which they instructed me to make non-negotiable in order to gain acceptance. The instrument was tendered to achieve derecognition of the outlined obligation through accord and satisfaction by use of an instrument ( XXXX XXXX ). XXXX is a common accounting practice that is in accordance with XXXX and XXXX accounting principles. The assertion that we are not in a prepaid electronic credit based monetary system is one made to intentionally violate the rights of the consumer and avoid penalties that will be sanctioned by the CFPB, FTC, IRS, SEC, etc.. I am not incompetent and I fully understand my rights that are outlined in TILA, DODD-FRANK, UCC, and several other laws that dictate the duties of security XXXX and financial institutions when handling consumer contracts and accounts. I have tried everything in my power to remain in honor and operate in good faith.
I now need the CFPB to step in and enforce my equitable rights to set-off according to the Dodd-Frank Act and TILA. I also need the CFPB to enforce my rights to protection against illegal debt collection practices governed by the FDCPA.

As we prepared to sell our home last XXXX ( XXXX ) the head of our church congregation sent a {$700.00} mortgage payment for that month to XXXX of XXXX addresses listed on the bill. He chose the wrong address, and then sent XXXX payments ( {$1400.00} ) on XXXX check the following month ( XX/XX/XXXX ).
We closed on our home XX/XX/XXXX, paid off the mortage, and moved to XXXX, XXXX to find more affordable housing, Our latest bid for another home there was accepted last month ( XX/XX/XXXX ). Our closing date was set for XX/XX/XXXX, if I recall correctly.
On XX/XX/XXXX, our loan XXXX called to inform us that he could not proceed with the purchase of our new home ( now still under contract, by the grace of XXXX ) without resolving what was showing on our three credit reports as a 30-days late payment from our former lender, Shellpoint Mortgaging Services ( formerly NewRez ).
Shellpoint asked us to send a letter to resolve the problem. We overnighted that letter the same day ( XX/XX/XXXX ). We have had no word on their decision as yet. We have called at least three times. Anything you can do is appreciated.

on XX/XX/XXXX, new rez paid XXXX XXXX for a policy that is not mine. the policy was not in my name and the insurance coverage was inadequate to cover my loan amount.
XX/XX/XXXXXXXX XXXX XXXX notified me that this was my final notice before cancellation.
i contacted new rez, inquiring about the payment. i learned they paid the wrong company.
XX/XX/XXXX, new rez sent a payment to XXXX XXXX.
of course, both insurance payments put my escrow account in the negative. i called for the XXXX policy to be returned to my escrow account. this issue has not been resolved.
on 4 occasions, a representative said that the error can not be corrected until XXXX refunds the payment. my problem with this is i have no control over the error that was made or when/if XXXX will return the payment. the XXXX payment needs to be credited back to my account. as of XX/XX/XXXX, the payment has not been credited and the representative says they have submitted a payment retrieval to XXXX. at this point, the payment retrieval is between new rez and XXXX.

From day XXXX since I was terminated from my job of 4 years, I then telephoned Shellpoint and asked them for options where I can save my home in the mist of me loosing my job. I was able to be put on a deferment and a forbearance. I was clockwise with the calls and filling out the paperwork for me to still be in the clear until I was able to obtain full-time employment. I have paperwork still where I made arrangements with them so I could avoid loosing my home. When I tried to send in partical payments I was told that they needed to be the entire payments. Still I was very consistent to letting them know that I was deeply impacted by the Covid- XXXX and that my income was limited to none. This mortgage company then slid my mortgage into default and my house is up for foreclosure which was not right.

Shellpoint while under this federal complaint still put my loan into foreclosure XXXX XXXX with Attorney XXXX XXXX XXXX XXXX XXXX, I had to call this Attorney and provide him with the federal case number I filed against shellpoint and it was in the Federal Courts, this attorney confirmed then removed my home from foreclosure as Shellpoint CONTINUED Harassment of me against my loan with Continued Violations of Foreclosure with an OPEN FEDERAL Case against them.
Shellpoint still continued to place Fraudulent Escrow shortage for me to pay that I do NOT OWE, I do send Shellpoint all letter, legal Federal Case filed, XXXX department of banking Response letter FROM SHELLPOINT COMPLIANCE Department with XXXX XXXX name at the bottom of letter, Shellpoint IGNORE all Legal documents I continue send with Violations of federal and State Laws, misappropriation of my payments undisputed not including Fraudulent Escrow, they keep the payment until it will total the falsified Escrow over {$1100.00} a month for the mortgage payments, Fraudulent, False Fees, I have sent Shellpoint My Federal Case that was filed against them, yet they keep moving in a Fraudulent manner, keep saying I am researching, keep sending me the same letter they are researching but it will take time due to the complexity, Yet Shellpoint Never do anything just keep adding Fraudulent fees, attorney fees, inspection fees, fraudulent foreclosure fees while I have file federal case in court they still charged me attorney fees on my loan! Today, I have been speaking with Shellpoint and I continue to dispute the Falsified, Illegal, Fraudulent Escrow payment, along with other legal fees, inspection fees, erroneous foreclosure fees, placed on my mortgage loan, I have a balance of under {$65000.00} owed and Shellpoint Misappropriation of my undisputed principal and interest caused my loan to become delinquent with fraudulent fees, NEVER ITEMIZED!! just letters of falsified information stating it came from Ditech with a ESCROW Negative, so Falsified, and Fraudulent.
I have supporting documents and provided them to Shellpoint as they continue to ignore and keep illegal fees on my loan that is NEVER VALIDATED, Just words on what they say happened, I even have the letter I sent to them dated XXXX XXXX Dispute of the Illegal, Fraudulent Fees.
Shellpoint Response Letter XXXX XXXX Paragraph XXXX, letter response to my complaint, shellpoint mortgage began servicing my loan XXXX XXXX ( I agree ) Paragraph XXXX, Reviewing the records of the account the Escrow balance has not been Positive since prior XX/XX/XXXX, FALSE Loan was Transferred from Ditech XXXX XXXX without any deliquenties, on XXXX XXXX Shellpoint completed an updated escrow analysis, while there is a current escrow negative balance of {$16000.00}. the required escrow balance is calculated based on anticipation disbursements!! as well as required cushion and when the disbursement is made on Bills!! BILLS?
There are two options provided to pay the shortage back.
a. make a one time payment of {$17000.00} the monthly payment would be {$830.00} beginning XXXX XXXX or b. pay through increase Escrow Shortage! All Falsified, Fraudulent, Ditech Loan from XXXX this is LUDACRIS and FRAUD!
as of XXXX XXXX I am do for XXXX payments and I have continued to dispute the Fraudulent Modification Shellpoint wanted me to pay with Large Falsified Escrow amount of - {$19000.00}, I told Shellpoint I was approved for the HAF State program to bring Loan Current But the XXXX XXXX XXXX Underwriters had to get my last 3 months statement, once the HAF counselor review the statements they will NOT pay this current knowing NO ESCROW should be this high, I sent the HAF State homeowners assistant every document, including the Federal Case I filed showing I know this is Illegal and Fraudulent. HAF State program indicated that Shellpoint need to correct this Violations of the Laws as it pertains to my mortgage Loan, and HAF Can NOT bring my loan current for these XXXX XXXX XX/XX/XXXX payments with a Erroneous, Fraudulent Escrow over {$19000.00} the escrow payment is fraudulent and it is included as my past due owed to shellpoint. XXXX XXXX I told shellpoint that I was approved to bring loan Current, But HAF Will Not pay these Fraudulent, False Escrow and that Shellpoint need to REMOVE fees, and or ITEMIZE how can TAXES and INSURANCE be {$19000.00}. My processor with the HAF State program stated XXXX XXXX you are APPROVED but Shellpoint must remove the Falsified Escrow balance, she calculated my insurance with State Farm XXXX, and my XXXX XXXX Taxes of {$2400.00} yearly and it will NEVER be {$19000.00}. I was also provided with information showing Shellpoint/Newrez have had a class action lawsuit settlement for these same kind of violations in various states.
I would like to bring my loan Current, and also working with a company to help me pay off shellpoint but not under these Fradulent fees. NO ONE will assist in paying Fraudulent, Falsified, Erroneous FEES.
XX/XX/XXXX, I was diagnosed with XXXX XXXX, with an XXXX XXXX to follow immediately, being that I filed the case XXXX in federal court, I called the Courts and informed them I could No Longer run to the courts to file response, etc.
